Renting With ASNEF in Spain: What Landlords Actually Check

Nobody in Spain is legally barred from renting because of a debt file. In practice the landlord's insurer decides, and it never meets you. The useful question is not whether ASNEF blocks you, it is which layer of the screening it sits in.

What the file is, and what it is not

ASNEF is a private solvency database run by Equifax. Creditors who are members report unpaid debts: banks, telecoms, utilities, sometimes a property manager or a community of owners. BADEXCUG, run by Experian, is the other one you will hear about. Nothing in the Ley de Arrendamientos Urbanos mentions these files. There is no article that says a tenant in ASNEF cannot sign a lease.

What decides instead is the rent-default insurance. Most agencies and a growing number of private owners carry a policy that covers unpaid rent, and the insurer scores the applicant before the policy is issued. A file entry is a negative score, and a negative score comes back as a refusal that the agent passes on as 'the owner chose someone else'. That is the whole mechanism, and it explains why the same person is rejected in Eixample and invited to a viewing in Cabrils.

Data protection law, not housing law, sets the limits. A debt can be listed only if it is certain, due, enforceable, above 50 euros, and was claimed from you beforehand in a way the creditor can prove: a burofax, a certified letter, a recorded notice. Once you pay, the entry has to come out. If you never pay, it goes anyway five years after the due date.

The rules on the entry itself

Which means a large share of the entries people panic about are either invalid or already dead. Order the report before you start viewing. Equifax gives you your own data free of charge, and so does Experian. Read the list for three things: an amount under 50 euros, an entry older than five years, or a debt you already settled. Any of those can be challenged, and the claim costs nothing but a registered letter.

Income stability comes first. A Spanish payslip, an alta in the Social Security, two years of autónomo returns, or a contract with a Spanish entity. Foreign income is not worthless, but a landlord cannot enforce a salary paid in London the way a Spanish court can enforce one paid in Mataró, and the insurer prices that difference in.

Payment history comes second: six to twelve months of statements, read for the pattern of money coming in and rent leaving, not for the closing balance. ASNEF sits in the third layer, with the guarantees. It matters most where the file is checked mechanically, which means agencies, corporate landlords and anything with a default policy attached.

What gets read first, second and third

None of these erases the file. All of them change the decision, because they move the risk off the insurer's balance sheet and back onto yours or someone else's.

Five levers that still work

Agencies that promise to 'clean your ASNEF' for 300 to 800 euros cannot delete accurate data. Only the creditor can withdraw a valid entry, and a company that talked Equifax into removing a true debt would be breaking the law, not helping you. What some of them actually do is check whether the entry is invalid and send a claim, which you can do yourself for the price of a stamp.

The other classic is the landlord who asks for a deposit before any viewing because 'the file needs checking'. Nobody legitimate needs money to read a solvency report. If the flat is priced well below the street and the owner is abroad, walk away and keep the messages.

The part that is a scam

Week one, order both reports and write a one-page summary of your situation: what the debt was, when it was settled, what you earn now, what guarantee you can offer. Week two, collect the boring file: DNI or NIE, contract, three payslips, six months of statements, last tax return. Week three, view with private owners and smaller agencies, and say the ASNEF line yourself before they find it. Week four, negotiate the guarantee, not the rent.

One last thing worth writing into the contract. If the guarantee is three months, the lease should say exactly what it covers, when it comes back and that it is returned within a month of handing the keys over. A file entry is a past problem. A deposit that never returns is a present one.
