Two names on one contract looks like a formality. In Spain it is a debt structure. The difference between one lease with four signatures and four separate leases is the difference between your problem and theirs, and it only becomes visible in the month somebody stops paying.
Spanish civil law separates two ideas that English speakers blur together. Mancomunada means each tenant answers for a share. Solidaria means any one of them can be pursued for the whole amount. Article 1137 of the Código Civil says solidarity is not presumed: it has to be agreed. That sounds reassuring until you read the actual contract, where the word solidariamente tends to appear in the paragraph about payment obligations, quietly and without emphasis.
Landlords want solidarity because it turns four small risks into one large one. If one flatmate loses a job in month seven, the owner does not chase that person through a small-claims court. They call whoever is easiest to find and ask for the full month. You then have a claim against the flatmate who did not pay, which is a second legal process, in a different court, with a person who has already shown you they cannot pay. Assume joint exposure unless the paper says otherwise in plain words.
Courts have gone both ways when the contract is vague, and the factors they weigh are unhelpful to the tenant: a single indivisible rent, one set of keys, shared use of the whole flat. Silence is not a strategy. Ask for the clause in writing before you pay the reservation, not after.
Handing back the keys does not remove a name from a contract. To get out properly you need the landlord to sign an addendum or a substitution, or the whole lease to be terminated and rewritten. Article 8 of the LAU requires written consent for any assignment, so a verbal yes from the agent is worth nothing six months later when the file is in front of a lawyer.
There are three honest routes. A substitution, where the leaving tenant finds a replacement who passes the same screening and signs; a continued obligation, where the person keeps paying a share until the lease ends because the landlord refuses to release them; or a full termination, which needs everyone to agree and usually costs the landlord a vacant month. The landlord chooses which one is available. You negotiate before the move, not after.
Marriage, a pareja de hecho certificate or a shared mortgage application changes nothing about the lease. If both sign, both are liable, and a separation does not automatically release the person who leaves. The law does allow a tenant to withdraw after the first six months with thirty days notice, and the contract usually adds a compensation formula, but that ends the lease for both of you, not just for one. If only one partner signs, the other has no right to stay after the relationship ends, however long they lived there and however much they paid.
If each of you signs a contract for a room, you are not co-tenants of a dwelling. You are a tenant of a room under an arrendamiento de habitación, which sits outside the five and seven year rules and outside most of the housing protection people assume they have. Since January 2026, in stressed-market municipalities, room rents are also capped and the sum of the rooms cannot exceed the ceiling for the whole flat, which is worth checking against the asking price.
The reverse trap is a group of friends renting a whole flat on a temporada contract because the owner prefers it. Temporada is for a stated, non-permanent reason. A group of adults with a two year plan is not that, and signing it gives up the long-term regime for a document that may not survive a challenge.
Put the utilities in one name and settle the split by transfer every month, with a concept line that says what it is. It feels bureaucratic for people who share a fridge. It is also the only thing that saves you when the person whose name is on the electricity contract moves to Berlin and leaves a debt that follows the supply, not the flat. Keep the receipts. A landlord or an embassy may ask for them.
Everyone living in the flat can register on the padrón, and a shared flat can carry several registrations. The town hall will want the contract and the owner's authorisation or signature, and in practice some owners refuse to sign for people who are not on the lease. That matters for a TIE renewal, a school place and the health card, so settle it before you move in rather than in the week the paperwork is due.
A joint lease is a reasonable instrument for a couple with aligned finances, or for people who have already lived together and know who pays on time. It is a bad instrument for near-strangers assembled by a group chat. The test is simple: would you lend this person three months of rent without a contract? If the answer is no, do not sign solidarity with them.
The alternative costs more per square metre and buys clean risk: separate room contracts, or a single holder with a written agreement and the owner's consent for the others to live there. Neither is elegant. Both are cheaper than discovering in month nine that your flatmate's share is now your share.
