A lease proves what you owe. A receipt proves you paid. Tenants lose deposit disputes, visa applications and arguments with a bank because they have the first and not the second. The law is on your side here, but only if you ask.
Article 17.4 of the Ley de Arrendamientos Urbanos obliges the landlord to hand you a receipt for each payment, unless the contract sets a payment method that already proves payment, such as a bank transfer. The receipt must itemise the amounts and show the current rent. If no receipt is given, the cost of proving you paid falls on the landlord.
Since 26 May 2023, rent for a vivienda must be paid by electronic means. Cash is allowed only if one party has no bank account or no access to electronic payments, at that party's request, and paid in the rented home. In practice this means a transfer with a clear concept line, which is the single best habit you can build in Spain.
If you pay community fees or utilities through the landlord, they must appear as separate lines, not folded into "renta". A single number is easy to dispute and useless when the rent is revised or when you need to show a bank what you actually pay each month.
A private landlord letting a home does not have to issue a factura with IVA. Residential rent is exempt from VAT, and the ordinary obligation is the recibo. A factura matters when the tenant is a company, when an autónomo uses part of the home for work, or when a relocation company is paying and needs an invoice with the landlord's NIF.
The bank statement proves money moved. The receipt proves what it was for. That distinction matters with partial payments, arrears, a deposit split into instalments, or a landlord who later claims the transfer was for something else. Keep both, and name the file properly.
Visa and residency renewals, opening a bank account, a mortgage application, school enrolment, the padrón and the annual tax return. The padrón usually asks for the lease and a utility bill, but a receipt helps when the lease is in someone else's name or the utilities are included in the rent.
If your employer pays the rent as part of a relocation package, the finance team will want a monthly document with the landlord's NIF. A WhatsApp screenshot will not do. Ask the landlord once, at the start, to send the same PDF every month, and the whole year stays clean.
Ask in writing, cite article 17.4, and offer a pre-filled template. If nothing comes, pay by transfer with a concept line: "rent October 2026, flat 2-1, Carrer de Mallorca 123". Send a short message afterwards confirming the payment. A reply is evidence; silence plus a bank statement is still decent evidence.
For a real dispute, a burofax with text certification costs about €20–30 and gets attention. Do not withhold rent to force a receipt. Non-payment gives the landlord a much stronger case than a missing receipt gives you.
If the owner lives abroad, the paperwork changes. The owner files Modelo 210 in Spain, and in some cases the tenant is the withholding agent and pays 19% or 24% through Modelo 216. Get a gestor to confirm your case before you agree to pay gross, and keep the receipts that show what was withheld.
An owner who wants cash and no receipts is not automatically a fraud. But it puts the risk on you: no proof of payment, no proof of address, and a weaker position on the deposit. If the price is good enough to accept that, at least keep a signed note for every payment.
Fecha y firma." Print two copies.
It takes a minute at the start of the lease and saves a year of arguing at the end. The receipt is not a bureaucratic nicety. It is the paper that makes the rest of your Spanish paperwork work.
